1. وصف الخدمة1. Service Description

فهيم (Faheem)، المتاح على www.enkiz.org، هو منصة برمجية كخدمة (SaaS) تقدّم مساعداً ذكياً يعتمد على الذكاء الاصطناعي للإجابة على استفسارات العملاء بالاعتماد على قاعدة المعرفة الخاصة بالشركة المشتركة (الملفات والنصوص والصور التي ترفعها). تتوفر الخدمة عبر واجهة محادثة مضمّنة في موقع الشركة (widget) وقنوات تراسل متعددة (واتساب، ماسنجر، إنستغرام، تيليغرام، حسب الباقة). "فهيم" و"enkiz.org" في هذه الوثيقة تعنيان مشغّل المنصة، بلا ذكر كيان قانوني مسمّى. Faheem, available at www.enkiz.org, is a Software-as-a-Service (SaaS) platform providing an AI-powered assistant that answers customer questions from a subscribing business's own knowledge base (files, text and images it uploads). The service is delivered through a chat widget embedded on the business's website and through multiple messaging channels (WhatsApp, Messenger, Instagram, Telegram, depending on plan). "Faheem" and "enkiz.org" in this document refer to the platform operator, without reference to a named legal entity.

2. الحسابات والأهلية2. Accounts & Eligibility

يجب أن يكون عمرك ١٨ عاماً أو أكثر لإنشاء حساب مزوّد أو حساب شريك، بما يتوافق مع القسم ١٠ من سياسة الخصوصية. أنت مسؤول عن دقة معلومات حسابك، وعن الحفاظ على سرية كلمة المرور، وعن كل النشاط الذي يجري عبر حسابك. You must be 18 or older to create a provider or affiliate account, consistent with §10 of the Privacy Policy. You are responsible for the accuracy of your account information, for keeping your password confidential, and for all activity that occurs under your account.

3. الاستخدام المقبول3. Acceptable Use

• لا يجوز استخدام الخدمة لنشر أو توليد محتوى غير قانوني، أو منتهك لحقوق الغير، أو ينطوي على احتيال.You may not use the service to publish or generate content that is illegal, infringes third-party rights, or is fraudulent.
• لا يجوز إرسال رسائل مزعجة (spam) عبر القنوات المتصلة (واتساب، ماسنجر، إنستغرام، تيليغرام) بما يخالف سياسات تلك المنصات.You may not send spam through connected channels (WhatsApp, Messenger, Instagram, Telegram) in violation of those platforms' policies.
• لا يجوز محاولة الوصول إلى بيانات مزوّدين آخرين أو تجاوز العزل بين الحسابات (multi-tenant isolation).You may not attempt to access other providers' data or bypass the platform's multi-tenant isolation.
• لا يجوز إساءة استخدام المساعد الذكي بمحاولات لاستخراج تعليماته الداخلية، أو التلاعب به لتوليد محتوى ضار، أو إغراقه بطلبات آلية بقصد تعطيل الخدمة.You may not abuse the AI assistant by attempting to extract its internal instructions, manipulating it into generating harmful content, or flooding it with automated requests intended to disrupt the service.

4. تنويه بشأن مخرجات الذكاء الاصطناعي4. AI Output Disclaimer

ردود المساعد الذكي مولّدة آلياً وقد تحتوي أحياناً على معلومات غير دقيقة أو غير مكتملة. لا تشكّل هذه الردود استشارة قانونية أو طبية أو مهنية بأي شكل. يتحمّل المزوّد (الشركة المشتركة) وحده المسؤولية عن دقة ومحتوى المعرفة التي يرفعها، وعن مراجعة ردود المساعد بشكل دوري حين تتصل بقرارات مهمة لعملائه. The AI assistant's replies are automatically generated and may sometimes be inaccurate or incomplete. These replies do not constitute legal, medical or other professional advice of any kind. The provider (subscribing business) is solely responsible for the accuracy and content of the knowledge it uploads, and for periodically reviewing the assistant's replies where they touch on decisions material to its customers.

5. محتوى المزوّد والملكية الفكرية5. Customer Content & Intellectual Property

يحتفظ المزوّد بكامل ملكيته للمستندات والنصوص والصور التي يرفعها إلى المنصة ("محتوى المزوّد"). بإنشائك حساباً واستخدامك الخدمة، تمنح فهيم ترخيصاً غير حصري، عالمياً، ومحدوداً بمدة اشتراكك، لتخزين ومعالجة وفهرسة محتوى المزوّد (بما في ذلك تحويله إلى تمثيلات رقمية/متجهات ورسوم بيانية معرفية) بالقدر اللازم لتشغيل الخدمة وتوليد الردود. لا يمنحك هذا الترخيص أي حق ملكية لفهيم في محتواك. Providers retain full ownership of the documents, text and images they upload to the platform ("Provider Content"). By creating an account and using the service, you grant Faheem a non-exclusive, worldwide licence, limited to the duration of your subscription, to store, process and index Provider Content (including converting it into vector embeddings and knowledge-graph representations) to the extent necessary to operate the service and generate answers. This licence does not give Faheem any ownership interest in your content.

6. الاشتراكات والفوترة6. Subscriptions & Billing

تُقدَّم الخدمة عبر باقتين شهريتين ذاتيتي التسجيل عبر Stripe: أساسية Basic بسعر 70$ شهرياً ونمو Growth بسعر 200$ شهرياً — ولكل باقة حصة شهرية من المحادثات وميزات مبيّنة عند التسجيل وفي لوحة التحكم. تتوفر باقة أعمال Business عبر طلب عرض تجريبي وتسعير متفق عليه مباشرة مع فريق فهيم، وليست معروضة للتسجيل الذاتي. تُجدَّد الاشتراكات الذاتية تلقائياً كل شهر ما لم يتم إلغاؤها. The service offers two self-serve monthly subscription plans billed via Stripe: Basic at $70/month and Growth at $200/month — each with a monthly conversation quota and features shown at signup and in the dashboard. The Business plan is available by requesting a demo and agreeing pricing directly with the Faheem team; it is not offered for self-serve signup. Self-serve subscriptions renew automatically each month unless cancelled.

7. الإلغاء والاسترداد7. Cancellation & Refunds

يمكن إلغاء الاشتراك في أي وقت من لوحة تحكم المزوّد. لمزيد من التفاصيل حول سياسة الاسترداد وحقوق الانسحاب، راجع سياسة الاسترداد. A subscription can be cancelled at any time from the provider dashboard. For full details on refunds and withdrawal rights, see the Refund Policy.

8. التعليق والإنهاء8. Suspension & Termination

يجوز لفهيم تعليق أو إنهاء حسابك في حال الإخلال بهذه الشروط، أو عدم سداد الفوترة، أو إساءة استخدام الخدمة (بما في ذلك انتهاك سياسات القنوات المتصلة مثل واتساب/Meta). سنسعى، حيثما أمكن، إلى إشعارك مسبقاً قبل التعليق النهائي إلا في حالات الإساءة الجسيمة أو الفورية. Faheem may suspend or terminate your account for breach of these Terms, non-payment, or abuse of the service (including violations of connected channels' policies, such as WhatsApp/Meta). Where possible, we will attempt to notify you before final suspension, except in cases of serious or immediate abuse.

9. حدود المسؤولية9. Limitation of Liability

تُقدَّم الخدمة "كما هي" (as is) دون أي ضمانات صريحة أو ضمنية بشأن عدم الانقطاع أو خلوّها من الأخطاء. إلى أقصى حد يسمح به القانون، لا تتجاوز مسؤولية فهيم تجاهك عن أي مطالبة مجموع الرسوم التي دفعتها لفهيم خلال الاثني عشر شهراً السابقة للمطالبة. لا يُسقِط هذا البند أي حقوق إلزامية لا يجوز التنازل عنها بموجب قانون بلدك. The service is provided "as is", without express or implied warranties of uninterrupted or error-free operation. To the maximum extent permitted by law, Faheem's total liability to you for any claim will not exceed the total fees you paid to Faheem in the 12 months preceding the claim. Nothing in this clause removes any mandatory rights you cannot waive under the law of your country.

10. الخصوصية10. Privacy

تخضع معالجتنا لبياناتك الشخصية لـسياسة الخصوصية، وهي جزء لا يتجزأ من هذه الشروط. Our processing of your personal data is governed by the Privacy Policy, which forms an integral part of these Terms.

11. التغييرات على الشروط11. Changes to These Terms

قد نحدّث هذه الشروط من حين لآخر. سننشر النسخة المحدّثة على هذه الصفحة مع تعديل تاريخ "آخر تحديث"، وسنُشعِرك عبر الخدمة (مثل إشعار في لوحة التحكم) بالتغييرات الجوهرية. We may update these Terms from time to time. We will post the updated version on this page with a revised "Last updated" date, and will notify you through the service (e.g. a dashboard notice) of material changes.

12. الإطار القانوني الحاكم12. Governing Framework

تُصاغ هذه الشروط بما يتماشى مع مبادئ حماية المستهلك في الاتحاد الأوروبي (GDPR وتوجيهات حماية المستهلك) والمعايير الدولية العامة. لا يؤثر أي بند في هذه الشروط على الحقوق الإلزامية التي يكفلها لك قانون بلد إقامتك ولا يجوز التنازل عنها تعاقدياً. These Terms are drafted in line with EU consumer-protection principles (GDPR and consumer-protection directives) and general international standards. Nothing in these Terms affects the mandatory rights your local law grants you that cannot be waived by contract.

شروط برنامج الشركاء (ملزمة)Partner / Affiliate Program Terms (Binding)

هذا القسم يشكّل الشروط الملزمة لبرنامج الشركاء (Partner/Affiliate Program) لكل من يسجّل كشريك عبر join.enkiz.org، بالإضافة إلى القبول العام لهذه الوثيقة عند التسجيل. This section is the binding Terms for the Partner/Affiliate Program for anyone who registers as a partner via join.enkiz.org, in addition to general acceptance of this document at signup.

• العمولة: عمولة متكررة بنسبة 20% من كل دفعة اشتراك مؤهلة يدفعها مزوّد أحلته. النسبة الظاهرة في لوحة تحكم الشريك هي المرجع، وهي قابلة للتعديل من قِبَل الإدارة.Commission: a recurring 20% commission on every eligible subscription payment made by a provider you referred. The rate shown in your partner dashboard is authoritative, and is adjustable by the admin.
• الحد الأدنى للسحب: 25$ كحد أدنى لطلب الدفعة.Minimum payout: a $25 minimum balance is required to request a payout.
• فترة الحماية: تبقى كل عمولة معلّقة لمدة 14 يوماً قبل أن تصبح مستحقة الدفع، لإتاحة مجال لأي استرداد أو نزاع على الدفعة.Protection period: each commission is held for 14 days before becoming payable, to allow room for any refund or payment dispute.
• الاستردادات: أي استرداد لدفعة مزوّد مُحال ينتج عنه تسوية سلبية (خصم) تُطرح من رصيد عمولات الشريك.Refunds: a refund on a referred provider's payment creates a negative adjustment deducted from the partner's commission balance.
• الإحالة والنسبة: يُنسب المزوّد الجديد لشريك واحد فقط عبر كوكيز إحالة مدتها 60 يوماً (نسبة لمرة واحدة — أول شريك صالح يُنسب إليه المزوّد).Attribution: a new provider is attributed to exactly one partner via a 60-day referral cookie (one-time attribution — the first valid partner is credited).
• نافذة المطالبة اليدوية: يمكن للمزوّد المُحال المطالبة يدوياً بربطه بكود شريك خلال 14 يوماً من إنشاء حسابه إن لم تُلتقط الإحالة تلقائياً.Manual claim window: a referred provider may manually claim attribution to a partner code within 14 days of account creation if the referral was not captured automatically.
• حظر الإحالة الذاتية: لا يجوز للشريك إحالة حساب مزوّد يملكه أو يتحكم به هو نفسه.No self-referral: a partner may not refer a provider account they themselves own or control.
• الإنهاء: يجوز إنهاء عضوية الشريك في حال الاحتيال أو تقديم معلومات مضلّلة عن نفسه أو عن طريقة ترويجه، وفي هذه الحالة تُلغى أي عمولات معلّقة غير مدفوعة بعد.Termination: partner status may be terminated for fraud or misrepresentation about themselves or their promotion method, in which case any commissions not yet paid out may be forfeited.
• طريقة الدفع: تُصرف الدفعات عبر Stripe Connect أو تحويل يدوي، بحسب توفر Stripe Connect في بلد الشريك.Payout method: payouts are made via Stripe Connect or manual transfer, depending on Stripe Connect's availability in the partner's country.
